Terms of Service

1. What NY Notary Pro is (and is not)
NY Notary Pro ("the Service," "we," "us") is a recordkeeping tool for notaries public: an electronic journal, scheduling, reminder, and export service designed around New York's notarial recordkeeping rule (19 NYCRR §182.9). The Service is not a law firm and does not provide legal advice. The built-in law guide is an educational summary only; laws change, and you are responsible for verifying current requirements with the NY Department of State or your own counsel. Using the Service does not by itself make you compliant with any law.
2. Your account
You must provide a valid email address and keep your password secure. You are responsible for activity under your account. You must be a commissioned notary public (or applicant) or otherwise use the Service lawfully.
3. Your records belong to you — and stay accessible
Journal entries you create are yours. We will never block you from viewing, printing, or exporting your existing journal records because of your subscription status. If your trial or subscription ends, creating new entries is paused, but viewing, printing, and exporting your existing records remains free, always.
4. Retention, archiving, and deletion — read this carefully
New York requires you to retain notarial records for at least 10 years(19 NYCRR §182.9). The Service's free storage works as follows: entries are stored in the cloud for approximately 12 months from the date of the act. Before any entry leaves free storage, we (a) generate your yearly logbook as a single exportable file, (b) email it to your account email, and (c) provide a further 90-day grace period with reminders, during which you may download your records or subscribe to extended storage. After the grace period, entries not covered by a subscription are permanently deleted from our systems (a minimal deletion log is retained). Deletion from our systems does not end your legal retention duty — keep your exported records for the full 10-year period.Paid subscriptions extend cloud retention up to 10 years from the date of each act.
5. Plans, billing, and cancellation
The Service offers a free trial and paid subscriptions (billed monthly or yearly through our payment processor, Stripe). Prices are shown at checkout and may change with notice; changes apply at your next renewal. Subscriptions renew automatically until canceled. You may cancel at any time; cancellation stops future charges and takes effect at the end of the paid period. Fees already paid are non-refundable except where required by law or expressly stated otherwise. Applicable taxes may be added.
6. Acceptable use
You agree not to: misuse the Service or interfere with its operation; attempt to access other users' data; use the Service to create false or fraudulent records; upload unlawful content; or resell the Service without our written agreement. We may suspend or terminate accounts that violate these terms; if we do, Section 3 still applies — you can export your records.
7. Remote (electronic) notarization features
The Service records information about electronic/remote notarizations and can store related evidence you upload. You remain solely responsible for complying with NY electronic-notary requirements, including registration (Exec. Law §135-c), use of compliant technology and identity verification, and retention of audio-video recordings for 10 years (19 NYCRR §182.8). The Service does not itself provide the video platform or identity-proofing services.
8. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that records will satisfy any particular legal standard. Maintain your own exports of important records.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for all claims relating to the Service in any 12-month period is limited to the amounts you paid us in that period, and we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data (see Section 4 — export your records), or professional discipline arising from your own compliance obligations.
10. Changes to the Service or these terms
We may modify the Service and these terms. For material changes we will provide notice (in-app or by email) before they take effect. Continued use after the effective date is acceptance of the updated terms.
11. Governing law and disputes
These terms are governed by the laws of the State of New York, without regard to conflict of laws rules. Disputes will be resolved in the state or federal courts located in New York, and you consent to their jurisdiction.
